103 - Parent Visa

Parents or step-parents of settled Australian citizens, permanent residents, or eligible New Zealand citizens can apply for an Australia parent visa (subclass 103). This visa allows them to migrate permanently to Australia and reunite with their children. However, eligibility depends on factors such as the child’s residence status, the duration of the child’s stay in Australia, the balance of family test, and meeting specific health and character requirements.

Introduction

  • With a parent visa, you, your partner, and dependent family members can live in Australia permanently.
  • You can work and study in Australia while holding a parent visa.
  • Access to healthcare through Medicare is available and subsidized by the government.
  • After a waiting period, you can sponsor family members for permanent residency in Australia.
  • Social security benefits are available after a waiting period, subject to eligibility requirements.

To be eligible for a parent visa there are certain criteria that must be met:

The applicant

  • the applicant must have a child who is an Australian citizen, or
  • a permanent Australian resident, or
  • an eligible New Zealand citizen

The sponsor

If your child is not an eligible sponsor, you may be sponsored by the following persons:

  • your child’s partner
  • guardian or family member of your child
  • guardian or family member of your child’s partner
  • a community organisation

Balance of family test

In addition to the points mentioned above, you must be able to demonstrate that:

  • at least half of your children are permanent residents of Australia
  • the majority of your children permanently reside in Australia compared to any other single country

    If this visa is granted, you will be expected to comply with the Australia standards of living and it is critical that you and any additional family member comply with all Australian laws.

    The sponsor

    As the sponsor, you will be required to assist your family members and help them settle in Australia by providing the following:

    • moral support
    • adequate accommodation
    • financial support

    For the first two years of residency it’s crucial that the sponsor complies with these obligations.
