186 – Employer Nomination Scheme

  • If you have an employer in Australia who is willing to sponsor you, or have previously worked in Australia on a 457 Temporary Work visa, you may be eligible for an Employer Nomination Scheme visa (subclass 186).
  • The Employer Nomination Scheme offers permanent residency to skilled workers in Australia.
  • There are three streams available for the Employer Nomination Scheme visa: the Temporary Residence Transition stream, the Direct Entry stream, and the Agreement stream.
  • The Temporary Residence Transition stream is designed for Temporary Work (subclass 457) visa holders who have worked for their nominated employer for two years and are now being offered a permanent role.
  • The Direct Entry stream is available for those who have been nominated by their employer or have not worked in Australia or have worked in Australia for a short time period.
  • The Agreement stream is for applicants who are sponsored by their employer under a labor agreement.
  • If you are granted an Employer Nomination Scheme visa, you will have permanent work rights and can remain in Australia indefinitely.

Introduction

The Employer Nomination Scheme is designed for skilled workers who have either held a Temporary Work visa (subclass 457) or have an approved Australian employer who is willing to sponsor them.

  • If you are granted an Employer Nomination Scheme (subclass 186) visa, you will have permanent residency in Australia.
  • You will be able to live in Australia indefinitely and have access to all the benefits that permanent residents enjoy.
  • You can study at any educational institute in Australia, including universities, TAFEs, and vocational training centers.
  • You will be eligible to enroll in Medicare, Australia's national health scheme.
  • Once you meet the citizenship criteria, you will be able to apply for Australian citizenship.
  • You will have the freedom to travel in and out of Australia for a period of 5 years from the date your visa is granted.
  • You will be able to sponsor eligible family members to come and live in Australia.

VISA APPLICANTS

  • To be eligible for the Employer Nomination Scheme (subclass 186) visa, you must have an employer who is willing to sponsor you, have held a Temporary Work visa (subclass 457), or be sponsored by an employer through a labor agreement.
  • The Employer Nomination Scheme offers three streams, which are the:
    • Temporary Residence Transition stream, for Temporary Work (subclass 457) visa holders who have worked in their nominated occupation for two years for an employer who wants to offer them a permanent role
    • Direct Entry stream, for applicants who have been nominated by an employer, have not worked in Australia, or have only worked in Australia for a short period of time, or are temporary residents who do not meet the criteria of the Temporary Residence Transition stream
    • Agreement stream, for applicants who are sponsored by an employer under a labor agreement.
