482 – Temporary Skill Shortage (TSS) visa

The Subclass 482 Temporary Skill Shortage (TSS) visa is designed to allow employers who are experiencing shortages of skilled workers to fill the gaps by recruiting from overseas. The visa is divided into four streams, each with its unique criteria that must be met by applicants.

FOR VISA APPLICANTS

In situations where no suitably qualified Australian employee can be found, the Short-term stream of the Temporary Skill Shortage (TSS) visa may be used to sponsor skilled foreign workers who have the necessary skills to fill the job offered by the employer.

The Short-term stream of the TSS visa allows the visa holder to:

  • work for their employer for up to 2 years in most cases, and up to 4 years if an International Trade Obligation (ITO) applies
  • study in an Australian educational institution (without access to government assistance)
  • travel in and out of Australia as many times as necessary while the visa is valid.

To be eligible for the Short-term stream of the TSS visa, the applicant must:

  • have an occupation that appears on the Short-term Skilled Occupations List
  • have at least 2 years of relevant work experience in the nominated occupation
  • obtain a skills assessment from the relevant assessing body (in certain occupations only)
  • work solely for the sponsoring employer
  • meet the English language requirements for the Short-term stream
  • meet health and character requirements
  • have health insurance
  • sign the Australian values statement
  • have no outstanding debts to the Australian government
  • not have had a previous visa cancelled or refused.

Family members who can be included in the application are:

  • the applicant's partner/spouse
  • the applicant's or their partner's dependent children.

Note that all included family members must also undergo health and character checks.

FOR EMPLOYERS

In situations where there is a shortage of skilled workers, organizations can sponsor suitably qualified and experienced foreign workers to fill nominated positions. The nominated position must be listed on the Strategic Short-term Skilled Occupations List (STSOL).

To be able to sponsor a skilled worker, the organization must first become a Standard Business Sponsor, which is valid for a period of 5 years if approved.

Nomination process: Before submitting the application, the applicant must be nominated by an approved sponsor. Nominations are valid for 12 months from the approval date or until one of the following events:

  • the TSS visa application is approved
  • the nomination application is withdrawn
  • three months after the Standard Business Sponsorship ends, unless a new sponsorship application has been submitted and is not finalized
  • the sponsorship approval is cancelled

When the nominee's visa application is decided, the sponsorship nomination must be active.

The sponsor's obligations: The nominating employer must:

  • ensure that the nominee only works in the nominated occupation
  • maintain appropriate records
  • provide equivalent terms and conditions of employment to the visa holder
  • provide records or information upon request
  • pay all travel costs
  • provide training to Australians and permanent residents
  • engage in non-discriminatory recruitment practices
  • pay for the removal of unlawful non-citizens
  • cooperate with inspectors.
