187 – Regional Sponsored Migration Scheme (RSMS)

  • RSMS allows regional Australian businesses to sponsor eligible candidates for a nominated position within their organization.
  • The candidate must be qualified for the position.
  • The nominated position must first be approved by the Department of Home Affairs before the visa can be granted.
  • RSMS is designed for skilled workers who are either located outside Australia or are skilled temporary residents currently working in Australia.

Introduction

The RSMS (Regional Sponsored Migration Scheme) is a program that allows skilled workers to be sponsored by employers in regional areas of Australia to fill nominated positions within their company. This program falls under the permanent Employer Sponsored visa program and has three different streams to choose from:

  • The Temporary Residence Transition stream, which is designed for skilled workers who currently hold a 457 visa, have worked for at least 2 years, and have been offered a permanent role by their current employer.
  • The Direct Entry stream, which is for skilled workers who have either not worked or only briefly worked in the Australian labour market.
  • The Agreements stream, which is for skilled workers who are sponsored by an employer through a labour or regional migration agreement.

VISA APPLICANTS

  • To be eligible for the Regional Sponsored Migration Scheme visa, you need to:

    • Have a business owner who is willing to nominate you for a position in their business in regional Australia.
    • Be under 50 years of age.
    • Meet the skills and qualification requirements of the Regional Sponsored Migration Scheme.
    • Meet the English language requirements.
    • Depending on your nominated occupation, salary and past work experience, there may be certain exemptions that apply to the age, skills, and past work experience criteria.

    If you are unable to find an employer who is willing to sponsor you, you can still submit an Expression of Interest (EOI) through the SkillSelect migration program. The EOI information will be visible to potential employers and state and territory governments. If you are nominated for skilled migration to Australia, you can apply for this visa.

    If you have been nominated for this visa, you must submit your application online within six months from the date the nomination was approved. When applying, you must select one of the three possible streams:

    • The Temporary Residence Transition stream is for applicants who hold a 457 visa, have worked for at least two years, and have been offered a permanent role through their current employer.
    • The Direct Entry stream is for applicants who haven't worked or have only briefly worked in the Australian labor market, have not held a 457 visa for the last two years, or are applying directly from outside Australia.
    • The Agreements stream is for skilled workers who are sponsored by an employer through a labor or regional migration agreement.

CONDITIONS

Employer Responsibilities:

The sponsoring employer must adhere to all the relevant labor laws, regulations, and award conditions applicable in the region where the skilled worker is employed. The employer must also provide the employee with a formal letter of employment that guarantees the following:

  • Full-time employment for at least two years or more
  • The position offered is located in a regional area of Australia

Employee Responsibilities:

Under the RSMS scheme, the skilled worker must comply with the following obligations:

  • Commence employment within six months of being granted the visa (if already in Australia) or within six months of arrival in Australia (if the applicant is overseas at the time of visa approval)
  • Work in the same regional area as the nominated position
  • Provide evidence that the two-year employment condition has been met, or the Department may revoke the visa at any time.
